Consolidated Edison Company of New York, Inc., and its nine co-plaintiffs-appellants (collectively “Con Ed”) appeal the decision of the United States District Court for the District of Columbia, entering summary judgment against them. Consol. Edison Co. v. Richardson, 55 F.Supp.2d 31 (D.D.C.1999).
