PROVO STY, J.
This is the fourth time the controversy between the Houssiere-Latreille Oil Company, hereinafter designated as “the company,” and the Jennings-Heywood Oil Syndicate, hereinafter designated as “the syndicate,” has been before this court in one or other of its phases. In the present proceeding the syndicate applies to this court for a writ of prohibition to prevent the judge of the lower court from entertaining jurisdiction of questions that are claimed to have been already passed upon by this court.
