This is an action of tort, which was heard by a jury, for personal injuries alleged to have been sustained by the plaintiff in the course of her employment by the defendant, who was not a subscriber to the workmen’s compensation law. See G. L. (Ter. Ed.) c. 152, §§ 66, 67. The defendant, at the argument in this court, waived its exception to the denial of its motion for a directed verdict.
