Appeal from Lucas District Court. — Hon. Frank W. Eichelberger, Judge. Action in equity on four counts to establish and foreclose mechanics’ liens on four different tracts of land belonging to H. D. Copeland, deceased. The trial court found and decreed that plaintiff was entitled to the establishment and foreclosures of the four mechanics’ liens on the different tracts of land belonging to the estate of H. D. Copeland, deceased, and which belonged to him at the time the materials were furnished. The defendants and interveners appeal.

At the time of the death of IT. D. Copeland he owned a large amount of land in Lucas county and it was supposed that his estate was solvent. The administrators were permitted to spend several thousand dollars for a mausoleum for the deceased. After the time for filing claims for mechanics’ liens had expired it was discovered that the estate was insolvent and that it would be necessary to sell the real estate to pay debts.
