This suit was brought in the district court of Shelby county, by the plaintiff in error, Fred A. White, against the defendants in error, Boyer Taylor and others. The trial court rendered judgment in favor of the latter, and White sued out a writ of error. The Court of Civil Appeals affirmed this judg-' ment, after having sustained the motion of the defendant in error to strike out the statement of facts which appeared in the record. 11 S.W.(2d) 374, 375.
