On November 13, 1974, petitioners Dana Rainwater, Martin Trejo, Lawrence Tully and Enrique Flores were found guilty of the crime of rape by a jury in the Circuit Court of the Eighteenth Judicial Circuit, Du Page County, Illinois. Rainwater is presently incarcerated at the Stateville Correctional Center in Joliet, Illinois pursuant to a four to six year sentence imposed by the trial court on January 13, 1975.
