Appeal from an order of the Supreme Court (Nolan, Jr., J.), entered August 15, 2001 in Saratoga County, which, inter alia, partially denied a cross motion by defendant Nathan Littauer Hospital & Nursing Home for summary judgment dismissing the complaint against it.

In this medical malpractice action, plaintiffs allege that defendant Daut S. Gjoni, an obstetrician, and the nursing staff of defendant Nathan Littauer Hospital & Nursing Home (hereinafter the hospital) failed to timely secure the services of an anesthesiologist prior to Gjoni’s delivery of plaintiffs’ son (hereinafter the infant)…
