This matter is before this Court on appeal on law from s judgment of the Court of Common Pleas of Franklin County, Ohio, based upon a verdict of a jury finding in favor of the plaintiff - appellee.

The petition alleges that on November 2, 1936, an agent of the defendant insurance company solicited the plaintiff to make application for insurance on the life of her brother, Albert Conley, in pursuance of which an insurance policy was issued, naming the plaintiff-1 appellee, Emma Sparks, as beneficiary.
