This ease is before the Court on the Government’s objections to Magistrate Judge Scott’s Report and Recommendation (Docket No. 107, United States v. Fisher, 2016 WL 2779018 (W.D.N.Y. May 13, 2016)), which recommends dismissing the superseding indictment without prejudice. In the alternative, Judge Scott recommends striking the superseding indictment’s forfeiture notice.
