The first matter comes before the Court on two motions: (1) the Motion for Summary Judgment (Doc. 12) filed by Defendant USAA General Indemnity Company ("USAA" or "Defendant"), and (2) the Motion for Partial Summary Judgment (Doc. 14) filed by Plaintiff Donovan Hinkle ("Hinkle" or "Plaintiff").
