This appeal raises important questions as to the propriety of a joint trial and the use of a confession obtained in the absence of counsel.

On the morning of October 27, 1964, when Isaac Wilson was found murdered in his restaurant in Rochester, suspicion almost immediately settled upon three men, the appellants Jackson and Bruton and their codefendant Alvin Peterson.
