Coen, at the September 'term, 1868, of the *290Court of Common Pleas of Fountain county, filed in said court a complaint against the appellee, Hiram Funic, guardian of Hester Ann Funk, to review a judgment rendered in said court in favor of the appellee, against the appellants, at the January term thereof 1861, as sureties of Thomas M.
