I. INTRODUCTION
Plaintiff Marcine Palkovic (“plaintiff’ or “Ms. Palkovic”) brings this action against defendants Michael J. Johnson (“Mr.Johnson”), the Averill Park Central School District (“District”), and the Averill Park Central School District Board of Education (“Board of Education”), pursuant to the Fifth and Fourteenth Amendments to the United States Constitution and 42 U.S.C. § 1983.
