*966In an action to recover damages for personal injuries, the defendant appeals from a judgment of the Supreme Court, Suffolk County (Sweeney, J.), entered April 12, 2010, which, upon the denial of its motion pursuant to CPLR 4401 for judgment as a matter of law, made at the close of the plaintiffs case, upon a jury verdict on the issue of liability finding it 70% at fault in the happening of the accident, and upon a jury verdict on the issue of damages finding that the plaintiff sustained damages in the principal sum of $60,000, is in favor of the plaintiff and against it in the principal sum…
