MEMORANDUM OF DECISION AND ORDER

Plaintiffs Essex Group Inc. (“Essex”) and Superior Telecommunications, Inc. (“Superior”) (collectively herein “the Plaintiffs”) filed this action for a declaratory judgment asserting that its use of the COBRA trademark did not infringe upon the Defendant’s alleged trademark rights in the COBRA trademark. Presently before the court is Defendant, Cobra Wire & Cable, Inc.’s (“CWC”) “Motion to Dismiss, Or, in the alternative, to Transfer” filed on May 19, 2000. On June 15, 2000, Plaintiffs responded and, on June 20, 2000, CWC replied.
