This is an action by the government to cancel and set aside patents issued for a number of tracts of land obtained under the coal land statutes, on the ground that they were obtained by fraud. The material allegations of the complaint are set out fully in the opinion of the United States Circuit Court of Appeals, when this case was in that court on appeal from a decree sustaining the demurrer to the complaint (203 Fed. 387, 121 C.
