This is a divorce action and in this opinion the parties will be referred to as they appeared in the trial court. Plaintiff in error was defendant.

On October 16, 1950, following a trial in which defendant appeared by his attorneys, a judgment was rendered and filed granting plaintiff a divorce and directing a division of property. The journal entry recites, in part:

“It is further ordered, adjudged and decreed by the Court that the property settlement agreement executed by the plaintiff and defendant and filed in this cause is hereby approved by the Court and is referred to and made a part…
