Charles M.Leighton, the appellee, commenced this action in the district court of Lancaster 'county, the object of the *428suit, as declared in the petition filed, being an accounting of the affairs of a copartnership which had previously-existed between him and Henry T. Clarke, appellant. The anieles of agreement pursuant to which the partnership was formed and existed were as follows:
