This is a rule to show cause why a mandamus should not be issued to require the collector of taxes of Deal borough, in the county of Monmouth, to pay over to the relator, as custodian of school moneys of Ocean township school district, certain moneys in his hands belonging to that district. The controversy is with respect to the sum of $3,057.19, which was assessed in the year 1903 upon the taxpayers resident in Deal borough for school purposes for the school year 1903-1904, collected by the respondent, then being tax collector of the…
