Anna Olson filed an information in the municipal court of Chicago charging plaintiff in error with an assault with a deadly weapon upon one Jonas Olson. Plaintiff in error was arrested and brought to trial. A jury was waived and. the cause was tried by the court. After the introduction of evidence on behalf of the People a motion was made by counsel for the plaintiff in error to dismiss the case on the ground that there was no evidence showing an assault with a deadly weapon, whereupon it was stipulated and agreed that the trial should proceed under the information as filed as if the…
