In an action to recover damages for personal injuries, the defendant Haym Solomon Home for the Aged appeals from an or*448der of the Supreme Court, Kings County (Bruno, J.), dated December 10, 2002, which denied its motion for summary judgment dismissing the complaint insofar as asserted against it, or alternatively, for summary judgment on its cross claims for contractual and common-law indemnification.
