THOMPSON, Circuit Justice.
The defendant recovered, in an action of ejectment, the premises on which the improvements now in question had been made, and the present action is brought under the provisions of a statute of this state to recover the value of such improvements. The plaintiffs were bona fide purchasers,, supposing themselves to have a good title to the premises.2 The improvements were made prior *297to the act under which the present suit is brought, which bears date on the 15th November, 1820.
