THIS MATTER comes before the Court on the Motion for Judgment on the Pleadings filed on September 26, 2003 (“Motion”) by defendants Larry Stroud (“Stroud”) and Brad Van Hull (“Van Hull”) (Docket # 48) and the Response thereto filed by Jeffrey A. Weinman, the Chapter 7 Trustee (“Trustee”) on October 16, 2008 (Docket # 50).
