Walter A. Johnson, named herein as Johnson, was 87 years of age in November 1955. He owned and lived for many years on the northeast quarter of Section 33, Township 10 North, Range 13 East of the 6th P.M., in Cass County. The land had been homesteaded by his father. Johnson was a long-time resident of that part of Nebraska. In recent years he lived with Alma E. Johnson, his daughter, hereafter referred to as appellant, who was a nurse and lived in Detroit, Michigan.
