This single asset chapter 11 ease is before the court on the motion of Walter F. Trent and Lynwood G. Willis (the “Partners”) to designate class three ballots of Condor One, Inc. (“Condor”) as not having been cast in good faith pursuant to 11 U.S.C. § 1126(e) and Condor’s response in opposition thereto. A hearing was held on this matter in conjunction with a confirmation hearing on the Partners’ and Condor’s competing chapter 11 plans on May 22, 1997.
