And now, before this court for consideration is defendant Lisa Bartley’s *3motion for summary judgment. Kevin Bonus, Kathleen Prell, Michael Mcllhargery, Legz Trucking Co. and Seven Fields Borough joined the motion. For the reasons set forth below, said motion is denied.

FACTUAL BACKGROUND
