This was an action in assumpsit brought by J. Blackburn Jones, appellee, against Mary Hopkinson, appellant, in the Kane county Circuit Court, to the.October term, 1886, and was tried at the October term, 1887.

The declaration contains three counts. The first one declares for services rendered • as an attorney; the second on an account stated between the parties for $3,038.59, and alleges further that, in consideration of the speedy payment, plaintiff would accept $2,888.59 in full settlement, provided said last sum was paid in sixty days from November 17, 1885, and that defendant neglected so…
