MORROW, Judge.
Conviction was for robbery, and punishment assessed at five years confinement in the State penitentiary.
The indictment charged the manner of the offense in the following language: “Did then and there unlawfully in and upon John Clark did make an assault and did then and there by said assault and by violence to the said John Clark, and by putting the said John Clark in fear of life and bodily injury”; and the case was submitted to the jury upon the issues thus alleged.
