R. V. Baker, administrator of the estate of C. A. Johnson, deceased, instituted an action of detinue in the circuit court of Cabell County against the Bank of Milton, to recover the possession of a negotiable promissory note for $4,000.00, dated the 9th day of April, 1924, executed by (Mrs.) G. A. Rogers and payable to bearer' on October 1, 1927. The defendant bank filed an affidavit in which it disclaimed title to the note and stated that the same was claimed by G. A. Rogers.
