This appeal is by the defendant from a judgment in the sum of $1,000 entered upon the verdict of a jury, motions for a new trial and in arrest of judgment having been overruled.

The statement of claim contains two counts, in the first of which it is averred that on May 31, 1921, defendant obtained from plaintiff the sum of $353.63 under false pretenses, stated to be the pretense of conveying to plaintiff all interest that defendant had acquired in certain real estate in Cook county, Illinois, by virtue of a tax deed, No. 30332-S,…
