The complaint alleges that Eugene Bozewski, who brings this action as administrator of his deceased wife’s estate, *795was driving at the time of the accident an automobile “ with the consent, express or implied ” of the owner of the automobile. The latter was a brother of the said Eugene Rozewski and is the defendant in this action." At the time of the accident the said Eugene Rozewski was accompanied by his wife who died as' a result of injuries received by her when the automobile, through the alleged negligence and carelessness of the driver, ran off the road at a curve.
