The defendant appeals from a judgment of conviction on the charge of robbery.

R. C. Elliott, the-prosecuting witness, testified that on April *97, 1921, be was in bis place of business in Salt Lake City and that at abont 3 p. m. of said day the defendant and another entered bis office, pointed a .45 Colt’s automatic pistol at him and commanded him to bold up bis bands . They took him into a back room, made him lie face downward on the floor, tied bis hands and feet, and gagged him; took about $15 be bad in bis pockets, bis watch, keys, and rings; searched the office in which nothing of value was…
