David B. Goldston, Jr. (“defendant”) appeals from an order and judgment of equitable distribution by the trial court. For the reasons set forth herein, we reverse in part the order and judgment of the trial court.

The pertinent facts of the instant appeal are as follows: On 24 April 2001, Debra B. Goldston (“plaintiff’) filed a complaint against defendant in Columbus County District Court seeking, in pertinent part, equitable distribution of the marital estate.
