Appeal from a judgment of the County Court of Broome County (Mathews, J.), rendered September 14, 2004, upon a verdict convicting defendant of the crimes of murder in the second degree, perjury in the first degree and reckless endangerment in the second degree.

Defendant was arrested after his live-in girlfriend’s four-month-old infant, who had been under his care, died from shaken baby syndrome.
