RICHARD BARAJAS, Chief Justice.

This is an appeal from the trial court’s granting of an award of attorney’s fees under Section 408.221 of the Texas Labor Code 1 in favor of Appellee. For the reasons stated herein, we affirm.

I. FACTUAL AND PROCEDURAL BACKGROUND

Appellant Pacific Employers Insurance Co. filed a petition July 1, 2008 appealing from a Texas Workers’ Compensation Commission Appeals Panel decision suing the injured employee and contesting the award.
