Appeal from a judgment of Onondaga County Court (Burke, J.), entered June 15, 1993, convicting defendant following a nonjury trial of, inter alia, murder in the second degree (two counts).

*935It is hereby ordered that the judgment so appealed from be and the same hereby is unanimously reversed on the law, the motion is granted, the indictment is dismissed and the matter is remitted to Onondaga County Court for proceedings pursuant to CPL 470.45.
