Plaintiff in error, James R. Sheppard, was tried before the judge without a jury in the criminal court of Cook County and convicted of the crime of assault with intent to kill and murder William Leahy, and sentenced to the penitentiary for a term of not less than three years nor more than five years. He prosecutes this writ of error.
