Appeal by the defendant, Joseph J. Hughes, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of Richniond, on the 6th day of May, 1909, upon, the verdict of a jury, and also from an order bearing date the 4th day of May, 1909, and entered in said clerk’s .office; denying the defendant’s motion for a new trial made upon the minutes. ’ •

Burr, J.:

Plaintiff alleges in his com plaint, first, an agreement with defendant to attend as a witness in ¿he Surrogate’s Court in New York county, *731upon the trial of a certain proceeding to be held therein for the probate of the will of defendant’s father, and, second, a further agreement to confer with defendant’s attorneys relative to the testimony which he should give upon such ’proceeding. In consideration thereof defendant agreed to pay plaintiff a sum equal to that which an attorney at law would reasonably charge for his time and services.
