Upon rehearing Mr. Chief Justice TERRELL, Mr. Justice WHITFIELD and Mr. Justice STRUM are of opinion that the decree in this cause should be reversed, while Mr. Justice ELLIS, Mr. Justice BUFORD and Mr. Justice BROWN are of opinion that the decree should be affirmed.
