RIPPLE, Circuit Judge.

The appellants, Victor Eugene Robbins, Sr. (“Gene”), Roy Gordon Robbins (“Gordon”) and James Herriman, were charged in a three-count indictment with various offenses arising out of a large-scale marijuana operation. Count I charged the defendants with conspiracy to possess with intent to distribute marijuana in violation of 21 U.S.C. §§ 841(a)(1) and 846. Count II charged Mr. Herriman with possession with intent to distribute more than 100 kilograms of marijuana in violation of 21 U.S.C. § 841(a)(1) and 18 U.S.C. § 2.
