In an action to recover damages for personal injuries, the defendants appeal, as limited by their brief, from (1) so much of an interlocutory judgment of the Supreme Court, Orange County (Onofry, J.), dated July 8, 2009, as, upon a jury verdict, found them 50% at fault in the happening of the accident, and (2) so much of an order of the same court dated September 11, *5422009, as denied their cross motion pursuant to CPLR 4404 (a) which was to set aside the verdict and for a new trial.
