People v. Sandoval

Appellate Division of the Supreme Court of the State of New York

Decided November 12, 1991Published

1Opinion of the Court

Appeal by the defendant from a judgment of the Supreme Court, Kings County (Starkey, J.), rendered June 1, 1989, convicting him of criminal possession of a weapon in the third degree and criminal possession of a controlled substance in the seventh degree, upon a jury verdict, and imposing sentence. The appeal brings up for review the denial, after a hearing, of that branch of the defendant’s omnibus motion which was to suppress physical evidence.

Ordered that the judgment is reversed, on the law, and a new trial is ordered. No questions of fact have been raised or considered.

There is no basis…
