This is an appeal from a judgment granting a peremptory writ of mandamus. On April 2, 1914, a vacancy existed in the office of the health commissioner of Kansas City, and an examination was held under chapter 88 of-the Laws of 19.13, by the civil service commission of that city,-to determine the qualifications and fitness of applicants for the position.- The papers were sent to Dr. S.
