Commonwealth v. Kohl
Supreme Court of Pennsylvania
1Opinion of the Court
OPINION
ZAPPALA, Justice.
The issue raised in these consolidated appeals is whether the chemical tests of breath, blood, or urine taken pursuant to the implied consent provision of the Motor Vehicle Code, 75 Pa.C.S.A. § 1547(a)(2), violate the federal and state constitutional prohibitions against unreasonable searches and seizures. We hold that the chemical tests authorized by § 1547(a)(2) *156violate the Fourth Amendment of the United States Constitution and Article I, § 8 of the Pennsylvania Constitution.
