The action arises out of the following facts: On February 3, 1915, one Joseph Hullar, father of the plaintiff, and Emma L. Hullar, his wife (since deceased), executed and delivered to the plaintiff a bond and mortgage to secure the payment of the principal sum of $1,000 in three years from the date thereof and interest payable semi-annually, at five per cent, which said mortgage was recorded in Onondaga county clerk’s office on February 2, 1916.
