On the evening of September 26,1916, Anton Kristel was struck by a westbound passenger train on a sidetrack of the Michigan Central Railroad in the City of Gary, Indiana, and was very seriously injured. He brought this suit in the Circuit Court of Will county, Illinois, against the railroad company to recover damages for said injuries and filed a declaration containing ten counts, in each of which he alleged that the accident occurred on the Taft street crossing, and in which he alleged negligent operation of the train; failure to…
