McWhorter, President:

This is an action of ejectment for seven hundred and ninety-acres of land in Randolph County, brought in the circuit court of said county by Genevieve B. Parr against Jonathan Cur-rence and William Currence. The tract of land sued for was granted by the Commonwealth of Virginia by patent dated the 1st day of January, 1851, to Caleb Boggess, who died intestate leaving the plaintiff his sole heir at law.
