Gerald Hirsch appeals from a judgment of conviction and sentence entered on December 21, 1999 by the United States District Court for the Southern District of New York (Deborah A. Batts, Judge ) after he pleaded guilty to six counts of mail fraud in violation of 18 U.S.C. § 1341. On appeal he argues that the district court (1) abused its discretion by refusing to allow him to withdraw his guilty plea; (2) erroneously denied him a three-level reduction in offense level for acceptance of responsibility pursuant to § 3E1.1 of the United States Sentencing Guidelines; and (3)…
