*1004In an action to recover on a promissory note, commenced by motion for summary judgment in lieu of complaint pursuant to CPLR 3213, the plaintiff appeals from an order of the Supreme Court, Queens County (Kitzes, J.), entered November 16, 2012, which denied his motion for summary judgment.

Ordered that the order is affirmed, with costs.
