KRUEGER, Judge.

The appellant was convicted of robbery by assault and violence alleged to have been committed on the 9th day of November, 1932, and his punishment assessed at confinement in the state penitentiary for a term of five years.

The record discloses that the court began on the 23rd day of January, A. D., 1933, and adjourned on the first day of April, 1933. The appellant in due time filed his motion for new trial and thereafter filed his amended motion for new trial, which was by the court heard and considered and on the 18th day of February, A. D., 1933, was in all things overruled,…
